29 CFR 1910.119(e)(3)(i): The process hazard analysis shall address the hazards of the process. The employer does not ensure that the process hazard analysis addresses the hazards of catalyst migration. The violation occurred on or about October 4, 2012 in the Hydrofining (HU)-10 unit, where employees were exposed to inhalation, fire and explosion hazards while performing routine job functions without addressing the hazards of catalyst migration and its consequences. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date the employer must submit documentation showing that it is in compliance with the standard, including descriptions of the steps it is taking to ensure that catalyst migration and its consequences are addressed in the process hazard analysis.

29 CFR 1910.119(f)(3): The operating procedures shall be reviewed as often as necessary to assure that they reflect current operating practice, including changes that result from changes in process chemicals, technology, and equipment, and changes to facilities. The employer shall certify annually that these operating procedures are current and accurate. The employer does not ensure that the annual certification of operating procedures is current and accurate. The violation occurred on or about October 4, 2012 in the hydrofining (HU)-10 unit where the Plugged Reactor Section and Process Description Manual procedures did not accurately reflect current operating limits. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date the employer must submit documentation showing that it is in compliance with the standard, including descriptions of the steps it is taking to ensure that the annual certification of operating procedures is current and accurate.
