29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii) Jobsite: The second level of the scaffold, on which an employee worked, was not fully planked. Just two planks were used on the five foot wide scaffold.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level. Jobsite: An employee working on the second level of fabricated frame scaffolding was not protected against falls. He was exposed to a fall hazard of approximately 14 feet.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. Jobsite: Employees have not been adequately trained in scaffold hazard recognition and control. Magny Construction was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 1926.454 (a) which was contained in OSHA inspection number 313768194, citation number 1, Item 3, issued on November 18, 2009 with a final order date of December 22, 2009.
