29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by a competent person prior to the start of work and as needed throughout the shift:    (a) Plumb N Time DBA Sewer Solutions, 3935 Irving, Denver, CO:  On or about October 2nd, 2012, the employer did not ensure the excavation located in the middle of Irving Street was inspected by a competent person prior to entry. An employee was observed working inside the 10 foot deep vertical walled excavation without a protection system to prevent cave-in.    Abatement Note: OSHA defines a competent person as an individual capable of identifying existing and predictable hazards in the surroundings, or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.    Abatement Note:  Abatement certification is required for this item (See enclosed Abatement-Certification Letter).
