29 CFR 1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  a)  For Citation 1, Item 1, issued on 3/22/2013 with an abatment date of 3/28/2013, the employer did not submit documents demonstrating complete abatement of the cited violation to OSHA.  b)  For Citation 1, Item 2, issued on 3/22/2013 with an abatement date of 3/28/2013, the employer did not submit documents demonstrating complete abatement of the cited violation to OSHA.

29 CFR 1926.1101(d)(5):     All general contractors on a construction project which includes work covered by this standard shall be deemed to exercise general supervisory authority over the work covered by this standard, even though the general contractor is not qualified to serve as the asbestos "competent person" as defined by paragraph (b) of this section. As supervisor of the entire project, the general contractor shall ascertain whether the asbestos contractor is in compliance with this standard, and shall require such contractor to come into compliance with this standard when necessary.    The employer did not insure that employees were adequately protected from asbestos inhalation hazards while performing work at the jobsite located at or about 414 W Main St, Collinsville, IL, including Blum House and the adjacent structures, and that the work was performed in compliance with this standard by a "competent person" by the asbestos contractor, SEG Construction LLC.

29 CFR 1926.1101(f)(2)(i):     Each employer who has a workplace or work operation covered by this standard shall ensure that a "competent person" conducts an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace. The assessment must be completed in time to comply with requirements which are triggered by exposure data or the lack of a "negative exposure assessment," and to provide information necessary to assure that all control systems planned are appropriate for that operation and will work properly.    The employer did not insure that the contractor employed to perform the roofing operations at the jobsite located at or about 414 W Main St, Collinsville, IL, including Blum House and the adjacent structures, was qualified as a "competent person" and had conducted an exposure assessment prior to the initiation of the work.  The "negative exposure assessment" presented by the employer was inadequate as it lacked air monitoring required under the standard.
