OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:    (a) Jobsite: 723 South Pike Road, Sarver, Pa 16055: On or before October 5, 2012, employees were working unprotected and exposed to falling approximately 18 feet 4 inches while gaining access to the roof by riding above the forks of an all-terrain forklift.

The operator was lifting employees and materials up to roof eave level.

The employees were applying roofing materials.

29 CFR 1926.503(a)(1):     The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    (a) Jobsite: 723 South Pike Road, Sarver, Pa 16055: On or before October 5, 2012, the employer did not train their employees on the hazards associated with falling while applying roofing materials on a steep sloped roof and what fall protection methods shall be used. Employees were anticipating that a 2x4 standing on edge would prevent a fall.
