29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    On or about October 11, 2012, during roofing activities including but not limited to installing coal tar pitch and fibre board, the employer did not ensure employees using a ladder to access the roof canopy to gain access to the main roof was properly extended above the surface at the top or provided with a grasping device.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and fuardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:    On or about October 11, 2012, during roofing activities including but not limited to installing coal tar pitch and fibre board, the employer did not ensure all employees on the roof were using a fall protection system/device on a flat roof with a fall height approximately 30 feet.    CAREY ROOFING AND CONSTRUCTION CORPORATION WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1926.501(B)(10), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 313455453, CITATION NUMBER 01, ITEM NUMBER 002, AND WAS AFFIRMED AS A FINAL ORDER ON JANUARY 20, 2010, WITH RESPECT TO A WORKPLACE LOCATED AT 2469 EAST 71ST STREET, CLEVELAND, OH 44114.
