29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.    The employer does not protect employees from excavated or other materials that could fall or roll into excavations.  This violation was observed on or about October 12, 2012, at the excavation site where employees were exposed to a struck-by and crushed-by hazard when working in an excavation that had the spoil pile at the edge of the excavation.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from excavated or other materials from falling or rolling into the excavation.

The employer does not protect employees from cave-ins when working in excavations.  This violation was observed on or about October 12, 2012, at the excavations site where employees were exposed to a cave-in hazard when working in an excavation that was 9 feet deep with no protection system.       Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected cave-ins when work in excavations that are 5 feet or more in depth.
