29 CFR 1926.52(d)(1):     In all cases where the sound levels exceeded the values shown in Table D-2 of 29 CFR 1926.52, a continuing, effective hearing conservation program was not administered:    (a) Galleria Mall - On or about 10/18/12, employees removing tile and mortar with bobcats equipped with chisels and jackhammers were subjected to noise levels ranging from 100 dBA to in excess of 110 dBA for up to 8 hours per shift, 5 days a week.  The employer has not established and administered a continuing and effective hearing conservation program.    An effective hearing conservation program consists of:  - Monitoring;  - Employee Notification;  - Audiometric Testing Program;  - Hearing Protection;   - Training; and,  - Recordkeeping.    ABATEMENT CERTIFICATION REQUIRED

Galleria Mall - On or about 10/18/12, employees remove tiles and mortar from the floors of the Mall for 8 hours a day, 5 days a week.  The materials being removed contain silica.  The employer has not provided information on silica to all employees engaged in this type of work, at the time of their initial assignment.    ABATEMENT CERTIFICATION REQUIRED
