29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c).     The employer does not protect employees from excavation cave-ins by an adequate protection system.  This violation was observed on or about October 17, 2012, at the job site near the intersection of Hwy. 59 N and E. Memorial where an employee was exposed to a crushed-by hazard while working in a 12 foot deep excavation that was not protected from cave-ins.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from crushed-by injuries form cave-ins while working in excavations.
