Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:     (a) On or about October 16, 2012, for the employees being used as a counterweight while riding on top of an overloaded skid steer loader and were exposed to a potential crushed and/or struck-by hazard, located at 2504 Rosser Avenue, Bismarck, North Dakota.        Abatement Note: Among other methods, one feasible and acceptable means of abatement to correct the hazard would be to comply with the Equipment Manufacturer's Institute (EMI) Skid Steer Loader Safety Manual for users and operators, which includes, among other requirements, the following:     1. Make sure no one is under the machine, on it or close to it.     2. Train skid steer operators to let other workers and bystanders know they are starting up and don't start until everyone is clear of the machine.     3. Do not overload a bucket or attachment.
