29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: a) Jobsite, 1400 Spring Garden St. - An employee in an aerial lift approximately 18' above ground level, was installing a banner on the side of the building. The employee was not wearing a harness or a body belt, with a lanyard attached to the basket, exposing the employee to a fall hazard. Observed on or about 10/23/12. NOTE: No abatement certification or documentation required.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. a) Jobsite, 1400 Spring Garden St. - Employees working in an aerial lift approximately 18 feet above ground level with no fall protection were not provided with training by a person qualified in the subject matter to recognize the hazards associated with aerial lifts, exposing the employees to a fall hazard. Observed on or about 10/23/12. NOTE: Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
