At the north side of the building, a tubular welded frame scaffold three frames high had 4 sections on the top frame where employees were working without guardrails and no other type of fall protection was provided, exposing employees to a 20 foot fall hazard.

At the perimeter of the building, a tubular welded frame scaffold three frames high was erected around the entire building to reach heights during cement block wall construction without having cross braces installed at the wall side on the second and third frames. The entire scaffold had braces on both sides only on the first frame.

29 CFR 1926.454(a):  The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards as required by paragraph (a)(1)-(5) of this section:    a. At the site, employees were in progress of cement block installation and were using a tubular welded frame scaffold with missing guardrails, missing cross braces and compromised footing.    Employees involved in scaffold use were not provided training and education in the following:    1. The nature of fall hazards and any falling object hazards.    2. The correct procedures for dealing with erecting, maintaining, and disassembling the fall protection system and falling object protection system being used.    3. The proper use of the scaffold, and the proper handling of material on the scaffold.    4. The maximum intended load and load carrying capacities of the scaffold.    5. Any other pertinent requirements of Subpart "L" (Scaffolds) under 29 CFR 1926.
