29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. a. On or about October 24, 2012, at the above addressed jobsite, employees conducting roofing operations were not provided training on how to minimize fall protection hazards, thereby exposing employee to the hazards associated with eight (8) foot eleven (11) inch falls. b. On or about October 24, 2012, at the above addressed jobsite, employees conducting roofing operations were not provided training on how to minimize fall protection hazards, thereby exposing employee to the hazards associated with thirteen (13) foot falls.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a. On or about October 24, 2012 at the above addressed jobsite, employees performing residential roofing operations on a low sloped roof (4:12 or less), eight (8) feet eleven (11) inches above the ground, were not protected from falls, thereby exposing employees to fall hazards. b. On or about October 24, 2012 at the above addressed jobsite, employees performing residential roofing operations on a low sloped roof (4:12 or less), thirteen (13) feet above the ground, were not protected from falls, thereby exposing employees to fall hazards.
