29 CFR 1926.95(a):     Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition, wherever it was necessary by reason of hazards of process or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact:    a)  On or about October 10, 2012, an employee was operating a Bosch Demolition Hammer, Model 11316EVS, S/N:  108000038, while not following the manufactures recommendation and utilizing hearing protection.    b)  On or about October 10, 2012, an employee was operating a Bosch Demolition Hammer, Model 11316EVS, S/N:  686001177, while not following the manufactures recommendation and utilizing hearing protection.
