29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  On or about October 23, 2012, employees were working in an excavation up to approximately 15 feet deep with only one ladder that was more than 25 feet away of where the employees were working, exposing employees to a cave in hazard.

29 CFR 1926.651(k)(1):  Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems.  On or about October 23, 2012, two employees were working in an excavation up to approximately 15 feet deep without a competent person inspecting the trench for a situation that could result in a cave in, exposing employees to a cave in hazard.

On or about October 23, 2012, employees were working in an excavation up to approximately 15 feet deep without an adequate protective system to protect employees from cave in and the ladder was more than 25 feet from where employees were working, exposing employees to a cave in hazard.

29 CFR 1926.1053(b)(1):  Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access.  On or about October 23, 2012, employees were working in an excavation up to approximately 15 feet deep using a 10 foot ladder that did not extend at least 3 feet above the landing, exposing the employees to a fall hazard.
