29 CFR 1910.178(l)(1)(i):     The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).    Throughout Facility- On or about October 26, 2012, operators were not trained in the safe operation of powered industrial trucks, thereby exposing employees to struck by hazards.

29 CFR 1910.178(l)(4)(ii)(B):   Refresher training in relevant topics shall be provided to the operator when:    The operator has been involved in an accident or near-miss incident;    East Loading Dock - On or about September 26, 2012, the employer failed to provide refresher training to a forklift operator after his involvement in an accident, thereby exposing employees to struck by hazards.

Throughout Facility - On or about October 26, 2012, an evaluation of powered industrial truck operators were not performed at least once every three (3) years, thereby exposing employees to struck by hazards.
