29 CFR 1926.300(b)(1): When power operated tools are designed to accommodate guards, they shall be equipped with such guards when in use. a. On the site where mortar was mixed to install block walls, the guards were removed from the top of the mixers and not replaced before using thereby exposing employees to a caught-in hazard.

29 CFR 1926.451(g)(4)(i): Guardrail systems shall be installed along all open sides and ends of platforms. Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews. a. On the east side of the Bellu scaffold platform, guardrails were not installed prior to allow masons laying brick from the oiutrigger of the scaffold thereby exposing employees to a 10'5" fall hazard. b. On the west side of the building where employees were laying block from a Bellu scaffold, guardrails were not installed prior to allowing the employees on the scaffold thereby exposing them to a fall hazard.

29 CFR 1926.1053(b)(17): Fixed ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, or corroded components, shall be withdrawn from service until repaired. The requirement to withdraw a defective ladder from service is satisfied if the ladder is either: a. At the front of the site where the mortar silo was located, the fixed ladder for gaining access to the top of the silo was damaged from being moved thereby exposing employees to a fall hazard.
