29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet or more in depth so as to require no more than 25 feet of lateral travel for employees:    (a)  St. Charles Realty Management, LLC @ 2000 Little Raven St., Denver, CO 80202:  On and before October 9th, 2012, the controlling employer did not ensure that each subcontractor employee conducting work in the excavation were provided with a safe means of egress from trench excavations, in that a stairway, ladder, ramp or other safe means of egress was located so as to require no more than 25 feet of lateral travel for employees.

29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):    (a) St. Charles Realty Management, LLC @ 2000 Little Raven St., Denver, CO 80202:  On and before October 9th, 2012, the controlling employer did not ensure that each subcontractor employee working within the trench excavation on the north side of the Flour Mill Lofts was protected from cave-in, in that, the excavation was measured depth of 11' and approximately 5'5"  in width and lacked any protective system such as sloping, benching, or a shield system.  Subcontractor employees were hand digging the trench in an attempt to locate a water leak. This condition exposed subcontractor employees to crushing hazards by excavation wall cave-in.
