29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns. On or about October 30, 2012, two employees were installing the flange at the end of the pipe, inside a trench measuring approximately 9 feet in depth, 44 inches in width at the bottom, and 53 feet in length, having vertical walls. Employees were not wearing hard hats while inside the trench, exposing the employees to the hazard of being struck by soil and/or cast iron flange. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected by protective helmets while working inside the trench.

29 CFR 1926.651(c): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. On or about October 30, 2012, two employees were installing the flange at the end of the pipe, inside a trench measuring approximately 9 feet in depth, 44 inches in width at the bottom, and 53 feet in length having vertical walls and was not provided with a ladder for access or egress to and from the trench, exposing employees to the hazard of being struck by soil. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a stairway, ladder, ramp or other safe means of egress is located in trench excavations.

Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that an inspection of the excavations is conducted by the competent person prior to the start of work and as needed throughout the shift.

Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee in an excavation is protected from cave-ins by an adequate protective system.
