An extension cord with a missing ground pin was used to energize a refrigerator (appliance was measured as carrying 25V on the exterior metal). 29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: a. Monitoring was not conducted to determine the need for a hearing conservation program, where saws and a planer were used at the shop; a radial arm saw was measured at 92 dBA, during operation. (Note: the establishment of a hearing conservation program, including using hearing protection when operating equipment at or greater than 90 dBA, providing annual hearing tests, and providing annual training on the use and need for hearing protection, can be implemented instead of conducting 8 hr monitoring.) Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.
