29 CFR 1910.95(d)(1):     When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:    a)  At the yard, an employee performing sandblasting operations was exposed to continuous and intermittent noise at 595% of the allowable eight-hour time-weighted average of 90dBA (90dBA threshold). The equivalent noise level of 595% is approximately 102.8 dBA. This exposure is 5.95 times the Permissible Exposure Limit (PEL). The monitoring was conducted for 198 minutes. Zero exposure was assumed for the un-sampled period of 282 minutes.    b)  At the yard, an employee performing sandblasting operations was exposed to continuous and intermittent noise at 778% of the allowable eight-hour time-weighted average of 90 dBA (90 dBA threshold). The equivalent noise level of 778% is approximately 104.8 dBA. This exposure is 7.78 times the Permissible Exposure Limit (PEL). The monitoring was conducted for 198 minutes. Zero exposure was assumed for the un-sampled period of 282 minutes.

The employer did not establish a respiratory protection program.   The employees were exposed to respirable crystalline silica as follows:   a) an employee was exposed to airborne levels of respirable silica at 14 milligrams per cubic meter (8-hour time-weighted average) while performing sandblasting and pot-tender operations.  This level is 36.5 times the OSHA Permissible Exposure Limit (PEL) of 0.37 milligrams per cubic meter.  Sampling was performed on October 30, 2012, for a period of 202 minutes.  Zero exposure is assumed for the remaining 278 minutes.   b) an employee was exposed to airborne levels of respirable silica at 28 milligrams per cubic meter (8-hour time-weighted average) while performing sandblasting and pot-tender operations.  This level is 76.2 times the OSHA permissible Exposure Limit (PEL) of 0.37 milligrams per cubic meter.  Sampling was performed on October 30, 2012, for a period of 210 minutes.  Zero exposure is assumed for the remaining 270 minutes.

29 CFR 1910.146(d):     Under the permit space program required by paragraph (c)(4) of this section the employer did not ensure that the requirements of (d)(1) through (d)(14) were met.    At the yard, two employees entered into a vacuum truck tank, at separate times, to remove a lining by sandblasting  inside of the tank. The employees were exposed to respirable Quartz Silica while inside of the tank. The employer did not establish a Permit-Required Confined Space program for the operation.
