29 CFR 1926.451(a)(1): Except as provided in paragraphs (a)(2), (a)(3), (a)(4), (a)(5) and (g) of this section, each scaffold and scaffold component shall be capable of supporting, without failure, its own weight and at least 4 times the maximum intended load applied or transmitted to it.    WORKSITE: The roof bracket scaffold and its components, installed on the 11 in 12 pitch roof were not capable of supporting the total load applied to the scaffold.    On or about November 5, 2012, while replacing underlayment and shingles on the 11 in 12 pitch roof the 2X10 board being used on the roof bracket scaffold failed, causing two employees who were not protected by an appropriate fall protection system to fall 17 feet to the ground.

29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    WORKSITE: The employees, installing shingles from the roof bracket scaffold on the 11 in 12 pitch roof were exposed to a 17 foot fall without adequate fall protection.    On or about November 5, 2012, while replacing underlayment and shingles on the 11 in 12 pitch roof the 2X10 board being used on the roof bracket scaffold failed, causing two employees who were not protected by an appropriate fall protection system to fall 17 feet to the ground.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. WORKSITE: The employees, installing shingles from the roof bracket scaffold on the 11 in 12 pitch roof were exposed to a 17 foot fall without adequate fall protection.    WORKSITE: The employees installing shingles on peak and at the rake edge of the 11 in 12 pitch roof were exposed to fall hazards exceeding 17 feet without an appropritate fall protection system.
