29 CFR 1926.501(b)(1):     Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    On or about 10/16/2012, an employee who was installing siding on the chminy of a tree story apartment building was not provided fall protection.    No other means of fall protection was used.

29 CFR 1926.503(a)(1):     The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    Employee installing siding on the chimney of a three-story building was not trained on fall protection. The employee was observed near the edge of the roof without the use of fall protection.

29 CFR 1926.1053(b)(1):     Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    Portable ladder used to access the roof top of a three- story building was not extended 3 feet about the landing of the roof.  The employee was installing siding on the chimney of the building.

29 CFR 1926.1060(a)(1)(iii):     The employer did not ensure that each employee using ladders and/or stairways had been trained by a competent person in the proper construction, use, placement, and care in handling the ladders and/or stairways:      Note:  29 CFR 1926.21(b)(2) may be cited as an additional violation to support this requirement.  See 29 CFR 1926.32(f) for definition of "competent person".    Employees using a ladder to access the rooftop of a building were not trained on the proper use of a ladder.
