29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: The employer does not provide information and training to employees on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced into their work area. This violation occurred on or about November 8, 2012, and at times prior thereto, when employees at the construction site were required to handle hazardous chemicals such as but not limited to before being trained on the hazards associated with the chemicals. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are trained on hazardous chemicals that includes the criteria in 29 CFR 1910.1200 (h).

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). The employer had not assessed the workplace to determine if hazards are present when employees are using hazardous chemicals. This violation occurred on or about November 8, 2012, when the employer did not complete a hazard assessment that describes the personal protective equipment employees use to protect themselves from the hazards associated with handling Silica, Toluene and other hazardous chemicals being used on the jobsite. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it it taking to ensure that a hazard assessment has been conducted to determine what type of personal protective equipment is to be used when using hazardous chemicals.

29 CFR 1910.1200(g)(1): Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use. The employer did not provide Material Safety Data Sheets in the workplace available for employees when using a hazardous chemical. This violation occurred on or about November 8, 2012, and at times prior thereto, when employees were required to work with hazardous chemicals without knowledge of the chemicals hazardous affects if exposed to skin and eye contact, ingested or inhaling could cause moderate to severe irritation. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showin that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are porvided Material Safety Data Sheets on each jobsites when using hazardous chemicals.
