29 CFR 1926.100(a):  Employees working in areas where there is was a potential of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.        On or about 11 November, 2012, at the construction site located at 3902 N. Highway 75 in Sherman, Texas, employees working in areas with masonry work above them were exposed to being struck by falling materials and/or hand tools.
