29 CFR 1926.501(b)(4)(ii): Each employee on a walking/working surface shall be protected from tripping in or stepping into or through holes (including skylights) by covers. Site: Pier (42) South Street & Montgomery Street New York, NY On or about 11/4/12 a) Employees were walking/working around skylights from approximately 25 feet high. The skylight was not guarded by a standard skylight screen or a fixed standard railing on all exposed sides.

29 CFR 1926.501(c): When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer shall re-train each employee: Site: Pier (42) South Street & Montgomery Street New York, NY On or about 11/4/12 a) Employees need to be re-trained specifically not to disconnect their fall protection harnesses when working/walking near unprotected skylights that may be hard to see in the sun gare.
