29 CFR 1926.451(a)(6):     Scaffolds were not designed by a qualified person    At this construction jobsite employees were elevated in a shop-made personnel  basket which was not designed by a qualified peson to heights of between approximately 33 feet to 39 feet. The personnel basket was not equipped with adequate guardrails to prevent falls from the basket.

29 CFR 1926.760(a)(1):     Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.    On the roof of a commercial building under construction, a decking crew was not provided fall protection while installing decking panels at heights ranging from 33 feet to 39 feet.
