29 CFR 1926.28(a):   The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions:    The employer does not ensure that seatbelt is worn when operating a front end/backhoe loader.  This violation was observed on or about November 13, 2012, on the construction site during a land preparation operation where employees were exposed to an ejection hazard when operating the CAT Front End/Backhoe Loader, model 416C without donning the seatbelt.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that appropriate personal protective equipment is worn by employees(s) in all operations where there is exposure to hazardous conditions.
