The requirements in this section apply to each such emergency action plan. (a) An emergency action plan was not developed and implemented. Employee evzcuation would beexpected in the event of an ammonia leak from the keg cooler refrigeration system.

29 CFR 1910.120(q)(1): Emergency response plan. An emergency response plan shall be developed and implemented to handle anticipated emergencies prior to the commencement of emergency response operations. The plan shall be in writing and available for inspection and copying by employees, their representatives and OSHA personnel. Employers who will evacuate their employees from the danger area when an emergency occurs, and who do not permit any of their employees to assist in handling the emergency, are exempt from the requirements of this paragraph if they provide an emergency action plan in accordance with 29 CFR 1910.38. (a) Employees were evacuated on 11/14/2012 by the Fire Department becuase of elevqated levels of Carbon monoxide (over 100 ppm). An Emergency Action Plan had not been developed and employees trained on its deployment.

29 CFR 1910.134(c): The employer did not develop and implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use: (a) A written respiratory protection program was not developed and implemented for: voluntary use of a half face respirator during dispensing corrosive chemicals, and the emergency evacuation respirator in the compressor room for the ammonia refrigeration equipment. Some of the topics the program should address would include medical evaluation, training, and maintenance of equipment.
