29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    Mendoza Used Brick Inc, at 1556 Cook Street, Denver, CO: On or about 11/14/12, Mendoza Used Brick Inc did not ensure protection was provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  Employees of Mendoza Used Brick Inc connected a sewer line while working in an approximate 8.5 foot deep excavation.  The spoil piles on the north and south sides of the trench extended to the edges of the excavation.  The employer did not ensure that the spoil piles were at least two feet from the edges.  This condition exposed three employees to an excavation hazard.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 29 CFR 1926.652(c):  Mendoza Used Brick Inc, at 1556 Cook Street, Denver, CO: On or about 11/14/12, Mendoza Used Brick Inc did not ensure that each employee in an excavation was protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 29 CFR 1926.652(c).  Employees of Mendoza Used Brick Inc connected a sewer line while working in an approximate 8.5 foot deep excavation.  The length of the excavation was approximately fifty five feet.  The employer utilized two sections of four foot by seven foot aluminum hydraulic shoring while in the excavation.  The employer did not ensure that employees were protected from cave-ins while working within the fifty five foot long excavation.  This condition exposed three employees to an excavation hazard.

The employer did not ensure that the excavation was backfilled following removal of the support systems.  This condition exposed three employees to an approximate 8.5 foot fall hazard.

Employees of Mendoza Used Brick Inc connected a sewer line while working in an approximate 8.5 foot deep excavation.  The length of the excavation was approximately fifty five feet.  The employer utilized two sections of four foot by seven foot aluminum hydraulic shoring while in the excavation.  The base of the shoring was pressed against the wall of the trench.  The employer had benched the excavation at a height of four feet from the bottom of the excavation.  The top half of each side of the shoring had a gap of 1.5 feet to each wall of the excavation.  The employer did not ensure that the shoring was installed in a manner to restrict lateral movement.  This condition exposed three employees to an excavation hazard.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:    Mendoza Used Brick Inc, at 1556 Cook Street, Denver, CO: On or about 11/14/12, Mendoza Used Brick Inc did not ensure that daily inspections of excavations, the adjacent areas, and protective systems were made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:.  Employees of Mendoza Used Brick Inc connected a sewer line while working in an approximate 8.5 foot deep excavation.  The spoil piles extended to the edges of the excavation.  Protective systems did not protect all employees in the excavation.  A daily inspection of the excavation was not performed by a competent person.  This condition exposed three employees to an excavation hazard.
