29 CFR 1926.21(b)(2) The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On or about September 27, 2012, the employer did not ensure that employees were trainerd to recognize and avoid unsafe conditions and the regulations applicable to their environment to control or eliminate any hazards or other exposure to illness or injury, whereby, an employee was working on an aerial lift within a 10 foot contact distance of a 12Kv overhead powerline; exposing the employee to severe shock and burn injuries.

29 CFR 1926.451(f)(6): Scaffolds were erected, used, dismantled, altered, or moved such that they, or any conductive material handled on them, could have come closer than the minimum distances established for specific voltages as set forth in the table in subparagraph (f)(6). On or about September 27, 2012, and times prior to, the employer did not ensure that employees performing work in an aerial lift near an overhead power line of 12Kv maintained a distance less than 10 ft and were kept from coming into contact with nearby power lines.

29 CFR 1926.95(b): "Employee-owned equipment." Where employees provide their own protective equipment, the employer shall be responsible to assure its adequacy, including proper maintenance, and sanitation of such equipment. OR IN THE ALTERNATIVE 29 CFR 1910.132(f)(1): The employer failed to provide to each employee personal protective training: On or about November 14, 2012, and times prior to, employees were exposed to falls and struck-by hazards, in that, the employer failed to ensure each employee bringing onto the jobsite their own Personal Protective Equipment (i.e. fall protection harnesses, safety glasses, hard hats, safety boots, and safety vest) be: 1) inspected, 2) maintained, 3) employee trained specific for use and associated hazards.

29 CFR 1926.95(d)(1): Except as provided by paragraphs (d)(2) through (d)(6) of this section, the protective equipment, including personal protective equipment (PPE), used to comply with this part, shall be provided by the employer at no cost to employees. The employer did not provide worksite PPE to employees that is not part of paragraph (d)(2) through (d)(5). Employees were required to purchase their own personal protective equipment.
