29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): Jobsite located at 2200 H Street, Fairbury NE: The employer failed to assess the potential hazards which are present or likely to be present at the worksite and then determine the appropriate type of personal protective equipment. On 11-09-2012, employees responded to a chlorine gas leak with the wrong protective equipment. One employee sustained minor injuries to the eyes as a result of the wrong type of protective equipment being utilized. Abatement certification is required for this violation. The abatement certification sheet is enclosed with the citations.

29 CFR 1910.147(c)(4)(ii): The energy control procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, including, but not limited to the items of this section: Jobsite located at 2200 H Street, Fairbury, NE; Throughout the Facility: Lockout/tagout procedures did not meet the requirements outlined above. The developed procedures are vague in that they do not clearly specify the techniques in which lockout operations will be performed and they do not clearly indicate the locations where energy may be isolated (switches, valves, breaker numbers, etc). Abatement certification is required for this violation. The abatement certification sheet is enclosed with the citations.
