29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. The employer does not provide access ladders or other means for accessing scaffold platforms. This violation was observed on or about November 20, 2012, on a scaffold at the job site where employees were exposed to a 13 foot, 6 inch fall hazard ascending and descending the frame of the scaffold. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from falling when accessing platfors on scaffolds.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews. The employer does not provide guardrails along all open sides and ends of scaffold platforms. This violation was observed on or about November 20, 2012, on a scaffold at the job site where employees were exposed to a 13 foot, 6 inch fall while working from the second tier of a scaffold that lacked both toprails and midrails. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from falling when working from scaffolds.
