OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling from an unstable ladder: a. On or about November 28, 2012, inside Terry Concert Hall, the extension ladder was unstable with the tops of the ladder's rails supported against a one-quarter-inch thick window pane, exposing an employee to an 18 feet fall hazard. Feasible means of abatement include, but are not limited to the following: 1. Erecting a scaffold as a working surface in place of the ladder 2. Utilizing a scissors lift as a working surface in place of the ladder 3. Fasten a manufacturer approved spreader stabilizer bar to the ladder rails to span the window frames

29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides: a. On or about November 28, 2012, on the flat roof, employees performing glazing work on the windows were not protected from an 18 feet fall hazard by the use of a fall protection system.
