29 CFR 1910.134(a)(1): When effective engineering controls were not feasible or while they were being instituted, appropriate respirators were not used pursuant to the requirements of 29 CFR 1910.134. On or about 28 November 2012, and at times prior thereto, an employee was using a concrete saw to cut bricks without the use of respiratory protection, exposing the employee to silica exposure and other various respiratory ailments. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure employees cutting bricks are utilizing a dust mask rated to provide protection for crystalline quartz silica dust.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents. On or about 28 November 2012, and at times prior thereto, an employee was using a concrete saw to cut bricks without the use of eye and face protection, exposing the employee to the hazard of being struck by flying objects. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure employees using concrete saws wear eye and face protection.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces or support legs were used as a means of access. On or about 28 November 2012, and at times prior thereto, three employees were working on a one-tier, tubular-welded frame scaffold without a ladder to access, exposing the employees to a fall hazard of approximately 7 feet and 6 inches. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure a ladder is utilized for accessing the scaffold.
