29 CFR 1926.451(a)(6):     Scaffolds were not designed by a qualified person.    On or about November 28, 2012 and times prior thereto, employees of Chano Paredes were observed working from a supported scaffold for framing a residence located at 9108 Weatherbee Circle in Sherwood, Arkansas.  The scaffold had been constructed onsite by the employer and the employees who were not qualified in the design and scaffolding construction requirements.  Employees were exposed to falls at a distance of 22 feet when working from the 2x6 unguarded platform constructed on the scaffold.

29 CFR 1926.451(b)(1):     Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii).    On or about November 28, 2012 and times prior thereto, employees of Chano Paredes were observed working from a supported scaffold consisting of a 2x6 wood platform atop wood framing while performing framing on a residence located at or near 9108 Weatherbee Circle in Sherwood, Arkansas.  The scaffold platform consisted of one 2x6 and was not fully planked or decked, exposing the employees to a falling distance of 22 feet to the first floor level below.

On or about November 28, 2012 and times prior thereto, employees of Chano Paredes were observed working from a supported scaffold consisting of two wood frames and a wood 2x6 platform while performing framing on a residence being constructed at or near 9108 Weatherbee Circle in Sherwood, Arkansas.  The platform was not at least 18 inches wide, exposing the employees to a falling distance of 22 feet to the first floor ground level below.

On or about November 28, 2012 and times prior thereto, employees of Chano Paredes were observed working on a 2x6 wood platform atop wood frame uprights while performing framing of a residence located at or near 9108 Weatherbee Circle in Sherwood, Arkansas.  The employees observed walking on the 2x6 wood platform were not protected from falling to the first floor level below, exposing them to falling hazards of 22 feet.

29 CFR 1926.501(b)(1):     Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    On or about November 28, 2012 and times prior thereto, employees of Chano Paredes were observed walking near unguarded edges in a residence being constructed at or near 9108 Weatherbee Circle in Sherwood, Arkansas.  The following instances were observed.    A. Employees were observed walking near an unguarded edge on the second story stairway opening with a falling distance of 9 3/4 feet to the first floor below, exposing employees to falling hazards.    B. Employees were observed walking near window openings which was unguarded at the edge to the outside ground level below, exposing employees to falling distances of greater than 6 feet.

29 CFR 1926.1052(c)(1):     Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail and one stairrail system along each unprotected side or edge.     On or about November 28, 2012 and times prior thereto, employees of Chano Paredes were observed walking on a stairway constructed in a residence being framed at or near 9108 Weatherbee Circle in Sherwood, Arkansas.  The stairway used by the employees was a stair set of 9 risers (5 1/2 feet) to a landing where a second stair set consisting of 7 risers led to the second story.  The stairway was not equipped with at least one handrail and one stairrail system along the unprotected edge, exposing the employees to a falling distance of 9 3/4 feet.
