29 CFR 1926.416(a)(1): Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means: (a) 421 Litchfield Avenue, West Babylon, NY (Worksite), southeast corner (front) of home, first floor roof - Employees re-roofing the first story roof were working near and directly below energized electric service lines. The employees were observed approximately 1 foot away from the electrical service lines. The electrical service lines were not de-energized and grounded, or guarded by insulation, on or about November 30, 2012. Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) Worksite, second story roof - An employee fell, approximately 20 feet to the ground below, while installing ashpalt shingles along the edge of a steep pitch roof (8:12). The employee was working without fall protection. The employee was not protected from the fall hazards to the ground below by a guardrail, safety net, personal fall arrest system, or alternate fall protection measure, on or about November 30, 2012. (b) Worksite, second story roof - An employee was performing roofing work along the edges of a steep pitch roof (8:12), without fall protection. The employees was exposed to falling approximately 14 feet to the next lower level and/or 28 feet to the ground below.The employee was not protected from the fall hazards by a guardrail, safety net, personal fall arrest system, or alternate fall protection measure, on or about November 30, 2012. (c) Worksite, first story roof - Employees were performing roofing work on a low pitch roof (4:12), without fall protection. The employees were exposed to falling approximately 11 feet to the ground below. The employees were not protected from the fall hazards by a guardrail, safety net, personal fall arrest system, or alternate fall protection measure, on or about November 30, 2012. Note: In addition to abatement certification, the employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) Worksite, west side of home, first story roof - Employees used a 24 foot fiberglass extension ladder, Werner Model D6324-2, to ascend and descend from the first story roof. The ladder's side rails were even with the eve of the roof and did not extend beyond the landing being accessed, on or about November 30, 2012. (b) Worksite, werst side of home, second story roof - Employees used a 36 foot aluminum extension ladder, Manufacturer and model unknown, to ascend and descend from the second story roof. The ladder's side rails extended beyond the landing being accessed approximately 18 inches, on November 30, 2012. In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
