29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) New Martinsville Villa Apartments: Employees using a ladder to access the roof of Building A at the site positioned the ladder such that the top of the ladder rails extended only two feet above the roof edge as determined on November 29, 2012. ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1060(a)(1)(iii): The employer did not ensure that each employee using ladders and/or stairways had been trained by a competent person in the proper construction, use, placement, and care in handling the ladders and/or stairways: (a) New Martinsville Villa Apartments: Employees using a ladder to access the roof of Building A at the site were not aware of the requirement to position the ladder such that the top of the ladder rails extended at least three feet above the level accessed to assure a safe transition to and from the ladder as determined on November 26, 2012. ABATEMENT CERTIFICATION REQUIRED
