29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: On or about December 3, 2012, at Queen's Manor Apartments, the employer did not ensure that employees walking under employees mounting and dismounting ladders were protected by hardhats from impact from such as but not limited to the ladder being displaced, insulation equipment and material or other falling or flying overhead objects. This practice created conditions which exposed the employees to struck by hazards.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: On or about December 3, 2012, at Queen's Manor Apartments, the employer did not enforce the proper use of an aluminum extension ladder. Employees were using a 16-foot aluminum extension ladder to gain access to a 2nd story doorway. The ladder did not have the side rails extended at least 3 ft. (.9 m) above the landing surface. This condition exposed employees to the hazard of stumbling and falling from an approximate elevation of 10-feet to the unfinished surface below during mounting and dismounting.

29 CFR 1926.1053(b)(8): Ladders placed in a location where they could be displaced by workplace activities or traffic, such as in passageways, doorways, or driveways, were not secured to prevent accidental displacement, nor was a barricade used to keep the activities or traffic away from the ladder. On or about December 3, 2012, at Queen's Manor Apartments, on a ladder, where the employer did not ensure employees traveling up and down from ground to 2nd story doorway secured the ladder to prevent accidental displacement nor barricaded to keep employees walking in and out of the doorway below away from the ladder. This practice created conditions which exposed the employees to the hazards of struck-by and stumbling and falling from the 2nd story during mounting and dismounting.
