29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: On or about November 30, 2012, and at times prior thereto, at the jobsite located at the intersection of Arch and Baseline in Little Rock, Arkansas, the employer did not ensure stairways, ladders or other safe means of egress were used in excavations more than 4 feet deep, exposing employees to the hazards of being caught in the excavations in the following locations as the installed plumbing: a) The excavation adjacent to the street measuring approximately 12 feet wide, 7 feet deep and 50 feet long. b) The excavation adjacent to the southwest corner of the building measuring approximately 7 feet wide, 6 feet deep and 30 feet long. c) The excavation at the southeast corner of the building measuring approximately 13 feet deep and 35 feet long.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. On or about November 30, 2012, and at times prior thereto, at the jobsite located at the intersection of Arch and Baseline in Little Rock, Arkansas, the employer did not ensure excavated material was placed at least 2 feet from the edge of the excavation, or otherwise restrained from falling or rolling into the excavations, exposing employees to struck by and caught in hazards in the following location(s): a) The excavation adjacent to the street measured approximately 12 feet wide, 7 feet deep and 50 feet long with a 5 foot high spoil pile within 2 feet of the excavation wall. b) The excavation adjacent to the southwest corner of the building measured approximately 7 feet wide, 6 feet deep and 30 feet long with a 5 foot high spoil pile within 2 feet of the excavation wall. c) The excavation at the southeast corner of the building measured approximately 13 feet high, spoil pile 7 feet high and 35 feet long.
