29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:     (a) Employees installing an Exterior Insulation Finishing System (EIFS) from 4-tier tubular welded scaffold systems were not able to recognize hazards associated with their work environment due to the employer not establishing an accident prevention program. Employees were exposed to fall and struck-by hazards as well as chemical burns while working with Portland cement.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):     (a) On the northeast side of the building, two employees were installing an Exterior Insulation Finishing System (EIFS) from a four-tier tubular welded frame scaffold system that was not fully planked. One employee was exposed to a fall of 19 feet, 10 inches while working from the third tier and the second employee working from the fourth tier was exposed to a fall of more than 25 feet.     (b) On the southeast side of the building, two employees were installing an Exterior Insulation Finishing System (EIFS) from a four-tier tubular welded frame scaffold system that was not fully planked.  One employee was exposed to a fall of 16 feet, 6 inches while working from the third tier and the second employee working from the fourth tier was exposed to a fall of 21 feet, 5 inches.

29 CFR 1926.451(e)(6)(i): Integral prefabricated scaffold access frames were not specifically designed or constructed for use as ladder rungs:     (a) On the northeast side of the building, employees were climbing the prefabricated end frame of a four tier tubular welded frame scaffold as if the frame had been designed for use as ladder rungs. The employer did not provide an access ladder, exposing the employees to a fall hazard exceeding 25 feet.     (b) On the southeast side of the building, employees were climbing the prefabricated end frame of a four tier tubular welded frame scaffold as if the frame had been designed for use as ladder rungs.  An extension ladder was installed to access the second tier. The employees were required to climb the end frame to access the third and fourth tier, exposing the employees to a fall of up to 21 feet, 5 inches.
