Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of a fall from elevation: On or about December 3, 2012, an employee was exposed to a fall of approximately 20 feet to the ground level below, while conducting EFIS work on an exterior wall of a retail building. The employee was using a Hy-Bird Scissor Lift Model 1430. The employee failed to keep both feet firmly positioned on the platform floor at all times. The employee climbed the scissor lifts guardrails to work at a height greater than the maximum working height of 20 feet. Among other methods, one feasible and acceptable abatement method to correct this hazard is to comply with ANSI A92.6-1990 for Self-Propelled Elevating Work Platforms: Section 8.10.Personnel Footing: Personnel shall maintain a firm footing on platform floor while working thereon on a lift with a working height of at least 23 feet 7 inches. The use of planks, ladders, or any devices on the platform for achieving additional height or reach shall be prohibited.
