29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Cross braces shall not be used as a means of access. a) Exterior supported scaffold at the west building fa�ade: Four employees were working on platforms of a 3-story-high 5-column-long supported scaffold. Employees did not have a means of safe access to the supported scaffolds, and used frames and cross braces of the scaffolds as a means of access. On or about 12/08/12. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT CERTIFICATION OF ABATEMENT FOR THIS ITEM. FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. a) Exterior supported scaffold at the west building fa�ade: Four employees were working on platforms of a 3-story-high 5-column-long supported scaffold, and were not protected from falling to lower levels by the use of fall protection systems. Employees were exposed to falling up to 30 feet from scaffold to ground. On or about 12/08/12. 29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. a) Jobsite: The employer did not provide training to four employees who were working on platforms of a 3-story-high 5-column-long supported scaffold. Employees could not recognize hazards associated with supported scaffold, and were exposed to hazards, including but not limited to: falling up to 30 feet from scaffold to ground without fall protection, climbing frames and cross braces of supported scaffold as a means of access, and working on scaffold platforms not fully planked or decked. On or about 12/08/12. NOTE: IN ADDITION TO CERTIFICATION OF ABATEMENT, THE EMPLOYER IS REQUIRED TO SUBMIT DOCUMENTATION OF ABATEMENT FOR THIS ITEM.
