29 CFR 1926.451(g)(1)(i):  Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system:    (a)	Michael Sarkes, 8602 Bauerdale Street, Parma, Ohio:  On or about December 11, 2012 at worksite located at 536 Cleveland Street, Elyria, Ohio, the employer did not ensure that an employee working on a ladder jack scaffold was protected by a personal fall arrest system.  An employee was removing shingles from a commercial structure while standing on a ladder jack scaffold.  The employee was exposed to a fall of approximately 12 feet to an asphalt surface.

29 CFR 1926.501(b)(10):  Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line systems and guardrail systems, warning line system and personal fall arrest system, or warning line system and safety monitoring system:    (a)	Michael Sarkes, 8602 Bauerdale Street, Parma, Ohio:  On or about December 11, 2012 at worksite located at 536 Cleveland Street, Elyria, Ohio, the employer did not ensure that each employee engaged in roofing activities on a low slope roof with unprotected sides was protected from falling.  Two employees were installing roofing material and were exposed to a fall of approximately 22 feet to an asphalt driveway.

29 CFR 1926.503(a)(1):  The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    (a)	Michael Sarkes, 8602 Bauerdale Street, Parma, Ohio:  On or about December 11, 2012 at worksite located at 536 Cleveland Street, Elyria, Ohio, the employer did not ensure that employees were trained in the proper application of fall protection systems while installing shingles on the roof of a two-story commercial structure.  Employees were not aware of fall protection requirements and methods to use to safely perform elevated work.

29 CFR 1926.1053(b)(1):  When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet above the upper landing surface to which the ladder is used to gain access    (a)	Michael Sarkes, 8602 Bauerdale Street, Parma, Ohio:  On or about December 11, 2012 at worksite located at 536 Cleveland Street, Elyria, Ohio, the employer did not ensure that the extension ladder used to access the roof extended at least 3 feet above the roof edge.  The ladder extended approximately 18 above the roof edge increasing the risk of falling when the employees climbed on to or down from the roof.

(a)	Michael Sarkes, 8602 Bauerdale Street, Parma, Ohio:  On or about December 11, 2012 at worksite located at 536 Cleveland Street, Elyria, Ohio, the employer did not ensure that the damaged extension ladder, which was used by employees to access the roof, was identified as defective and was taken out of service until repaired.  The ladder had one broken rung.
