The scaffold had legs and frames that did not bear on base plates and mud sills or other adequate firm foundation. The scaffold legs and frames were erected on hollow cinder blocks and masonry bricks stacked together vertically. On or about 12/12/12. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT CERTIFICATION OF ABATEMENT FOR THIS ITEM. FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Cross braces shall not be used as a means of access. a) Exterior supported scaffold at east side of house: Three employees were working on the 3rd platform of a 3-section-high supported scaffold. Employees did not have a means of safe access to the supported scaffold, and used frames and cross braces of the scaffold as a means of access. On or about 12/12/12. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT CERTIFICATION OF ABATEMENT FOR THIS ITEM. FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.

29 CFR 1926.451(f)(7): Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person. a) Exterior supported scaffold at east side of house: Employees erected a 3-section-high supported scaffold, which was used to do bricklaying and masonry work. The scaffold was not erected under the supervision and direction of a competent person. Employees who worked on the scaffolds were exposed to hazards, including but not limited to: falling approximately 18 feet from scaffold platform to ground, accessing scaffold platform by climbing cross braces, and scaffold legs not supported on adequate firm foundation. The employer did not have a competent person on site for the scaffold erection. On or about 12/12/12. NOTE: IN ADDITION TO CERTIFICATION OF ABATEMENT, THE EMPLOYER IS REQUIRED TO SUBMIT DOCUMENTATION OF ABATEMENT FOR THIS ITEM. Employees could not recognize hazards associated with supported scaffold, and were exposed to hazards, including but not limited to: falling approximately 18 feet from scaffold platform to ground, accessing scaffold platform by climbing cross braces, and scaffold legs not supported on adequate firm foundation.
