29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions:    (a) On or about December 12, 2012, and at times prior, where an employee was operating a chop saw to cut through brick and stone exterior without safety glasses, respiratory protection or hearing protection at the McDonald's restaurant located at 605 East Main Avenue in Bismarck, North Dakota.
