OSHAct of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to getting struck by a falling tree during manual tree felling operations:    (a) 600 Block of Taylor Road, Windsor, Pennsylvania - The employer did not ensure employees involved in tree removal, and operating a tagline, were kept outside of the striking distance, resulting in the death of an employee who was struck by the tree as it fell, on or about December 13, 2102.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.132(a):  Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:    (a) 600 Block of Taylor Road, Windsor, Pennsylvania - An employee used a chain saw on the ground to limb and buck felled trees, exposing the employee to a hazard of contact with the cutters and moving chain of the saw.  The employer did not require the employee to wear chain-saw-resistant leg protection (chaps), and the employee did not wear chain-saw-resistant leg protection (chaps), on or about December 13, 2012.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.

29 CFR 1910.132(d)(1):  The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment:    (a) 600 Block of Taylor Road, Windsor, Pennsylvania - The employer did not assess the workplace to determine whether hazards existed which necessitated the use of personal protective equipment.  The employer used a chain saw to trim and fell trees, and employees worked on the ground during this type of operation, exposing employees to an overhead hazard from dropped tools, branches, etc.  Also, an employee worked on the ground using a chain saw to limb and buck felled trees, exposing the employee to struck-by hazards from flying wood and bark, on or about December 13, 2012.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.

29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    (a) 600 Block of Taylor Road, Windsor, Pennsylvania - Employees had exposure to hazardous chemicals, including, but not limited to, gasoline, (which constitutes a Category 2 flammable liquid; a chemical which produces carbon monoxide, a chemical asphyxiant; and a chemical which can have damaging effects on the kidneys and liver).  The employer did not develop, implement, and maintain a hazard communication program, on or about December 13, 2012.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.
