29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). (a). Worksite located at 701 N. Cherry, Gladstone, Missouri- Employee was exposed to a fall hazard in that the employee climbed on to the guardrail of the aerial lift while he was not tied off with a lanyard to the aerial lift.

29 CFR 1926.1052(b)(1): Except during stairway construction, foot traffic is prohibited on stairways with pan stairs where the treads and/or landings are to be filled in with concrete or other material at a later date, unless the stairs are temporarily fitted with wood or other solid material at least to the top edge of each pan. Such temporary treads and landings shall be replaced when worn below the level of the top edge of the pan. (a). Worksite located 701 N. Cherry, Gladstone, Missouri- Employees were exposed to a fall or trip hazard in that employees were allowed to use steps in which the pans were not fitted or filled with materials to prevent trips.
