29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). a) At the worksite, the employer did not ensure that employees were provided and used fall protection while working from, accessing and/or exiting onto and/or off of roof area, from a JLG 600S Aerial Lift. Employees were installing shingles on an 8 in 12 pitch roof, approximately 40 feet high.

29 CFR 1926.501(b)(11): "Steep roofs." Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems. a) On or about December 13, 2012, during roofing activities, employees were observed working on the 8 in 12 pitch roof, approximately 40 feet high wihtout proper fall protection. The crew was in the process of repairing the roof with new shingles. James Mast Roofing was previously cited for a violation of this Occupational Safety and Health Standard or its Equivalent Standard 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 313997579, Citation Number 1, Item Number 2 and was affirmed as a final order on March 15, 2010, with respect to a workplace located at 2901 Harmont Avenue, N.E., Canton, Oh 44703.
