29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites: a) On or about 12/17/12, on construction site at the Sunoco Food Mart, 211 Niagara St., Buffalo, NY: An employee used a Craftsman Mitre Saw to cut plastic soffit material. The saw was connected to 120-volt ac power via an extension cord which was plugged into a wall receptacle inside the store. No GFCI or assured equipment grounding program was being used. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system: a) On or about 12/17/12, on construction site at the Sunoco Food Mart, 211 Niagara St., Buffalo, NY: An employee was on the narrow aluminum "pik" of a ladder jack scaffold erected on the south side of the building. The employee was installing soffits, and was exposed to a fall of approx. 15 ft. to the ground. The employee was wearing a full body harness, but was not tied off to an anchor point, and no other fall protection system was utilized. NO ABATEMENT CERTIFICATION REQUIRED
